Terms of Electronic Services (Regulamin)

These Terms of Electronic Services (“Terms”) set out the rules for using the electronic services made available through www.milkandsilk.studio (the “Website”), in accordance with the Polish Act of 18 July 2002 on Providing Services by Electronic Means (Ustawa o świadczeniu usług drogą elektroniczną).

1. Service Provider

The Website and the services described in these Terms are provided by:

(referred to as “we”, “us”, “the Service Provider”)

2. Definitions

• Website — the website available at www.milkandsilk.studio, presenting the portfolio and services of Júlia Štefková – Milk and Silk Studio, a creative studio.
• User — any natural or legal person using the Website or the Electronic Services.
• Electronic Services — services provided by us to Users through the Website without the simultaneous physical presence of both parties, as described in Section 3 below.
• Regulamin/Terms — this document.

3. Types of Electronic Services Provided

We provide the following Electronic Services free of charge through the Website:

1. Contact Form — allows Users to send an inquiry or business proposal to us by submitting their name, email address, and message.
2. Newsletter — allows Users to subscribe, using their email address, to receive periodic updates, news, and information about our studio and portfolio.

The Website does not offer any e-commerce functionality. No products or services can be purchased, and no user accounts or registrations are available on the Website.

4. Technical Requirements

To use the Electronic Services, a User needs:
– A device with internet access
– An up-to-date web browser with JavaScript and cookies enabled
– An active email address

We are not responsible for technical issues arising from the User’s hardware, software, or internet connection.

5. Rules for Using the Electronic Services

1. Use of the Contact Form and Newsletter is voluntary.
2. Users are required to provide accurate and truthful information when using the Electronic Services.
3. Users may not submit content through the Contact Form that is unlawful, offensive, infringes on third-party rights, or constitutes spam or unsolicited commercial content.
4. We reserve the right to disregard or delete messages that violate these Terms without further notice.

6. Conclusion and Termination of the Contract for Electronic Services

• The contract for use of the Contact Form is concluded at the moment the User submits the form, and is terminated once the inquiry has been handled or, at the latest, upon deletion of the related correspondence in accordance with our Privacy Policy.
• The contract for use of the Newsletter is concluded at the moment the User confirms their subscription (double opt-in) and continues until the User unsubscribes. Users may unsubscribe at any time, free of charge, by clicking the “unsubscribe” link included in every newsletter email, or by contacting us directly.

7. Complaints (Reklamacje)

Users may submit complaints regarding the operation of the Electronic Services by email to campaigns@milkandsilk.studio. A complaint should include:

• The User’s contact details (for a reply)
• A description of the issue

We will review and respond to complaints within 14 calendar days of receipt.

8. Liability

1. We make reasonable efforts to ensure the Website and Electronic Services function correctly, but we do not guarantee uninterrupted or error-free operation.
2. We are not liable for disruptions caused by circumstances beyond our control (e.g. force majeure, third-party service outages such as hosting, Google, or Brevo).
3. Our liability towards Users, to the extent permitted by applicable law, is limited to cases of intentional fault, given that the Electronic Services are provided free of charge.

9. Personal Data Protection

The processing of personal data in connection with the Electronic Services is described in our separate Privacy Policy, which forms an integral part of these Terms.

10. Intellectual Property

All content presented on the Website, including but not limited to the portfolio, images, texts, graphics, and layout, is the property of Júlia Štefková – Milk and Silk Studio, or is used under appropriate licenses, and is protected by copyright law. No content may be copied, reproduced, or distributed without our prior written consent, except for personal, non-commercial viewing.

11. Amendments to the Terms

We reserve the right to amend these Terms, in particular in the event of changes to the scope of the Electronic Services or applicable law. Amendments will be published on the Website with an updated “Last updated” date. Continued use of the Electronic Services after such changes constitutes acceptance of the amended Terms. Users subscribed to the Newsletter will be notified of material changes by email where required by law.

12. Governing Law and Dispute Resolution

1. These Terms are governed by Polish law.
2. Any disputes arising from the use of the Electronic Services will primarily be resolved through direct contact and negotiation between the parties.
3. Users who are consumers may also use the EU Online Dispute Resolution (ODR) platform, available at: https://ec.europa.eu/consumers/odr.

13. Final Provisions

These Terms enter into force on September 9, 2026 and apply to all Users of the Website’s Electronic Services from that date forward.
